摘要
土地承包经营权信托登记,是为了解决土地承包经营权已被信托的事实的信息披露问题而建立的信托管理制度,具有确权、公示公信、便于管理等功能。信托法第10条是关于信托登记制度的原则性规定,但缺乏应有的可操作性。文章从信托登记制度的主体(登记义务人、申请人、登记机关)、登记的内容以及登记的效力模式等方面,比较全面地探讨了土地承包经营权信托登记制度,建议制定与土地承包经营权信托登记相配套的法律法规,汲取域外信托法律制度的精华,树立全新的信托文化理念,在全面考量各方利益基础之上,构建合理且具操作性的土地承包经营权信托登记制度。
The establishment of trust registration system the land contract management right is to serve the function of disclosing information about land contract management rights being trusted. The registra- tion clarifies the rights, publicizes the information, and makes it easy for management. Article 10 of the Trust Law provides the principles for the trust registration system, but doesn＇t prescribe details for maneu- verability. This paper makes a comprehensive discussion about this trust registration system from aspects of registration content, validity mode, and which includes obligation to register, the applicants, the regis- tration authority. It is also recommended in this paper that corresponding regulations and laws be devel- oped to establish a reasonable and feasible land contract management right trust registration system. The making of this law system should be built on the introduction of the essence of foreign system, the devel- opment of brand-new trust culture and concepts, and consideration of the interests of all parties.
