摘要
航天商业发射保险经过长时间的发展已初具规模。当前,美、俄、法等主要航天大国都已出台了空间活动法对航天商业发射保险进行规范。而中国的航天商业发射保险法律制度还存在相关规定凌乱、缺乏基本立法,缺乏航天商业保险市场化的相关规定以及具体纠纷解决方式缺位等问题。对此,中国应在现有的保险法中增加航天发射保险的有关规定,允许外资保险公司进入航天商业发射领域,并尽早出台空间活动法规范航天保险业务,建立包括保险纠纷解决机制在内的外层空间活动商业化纠纷解决机制。
After a long-standing development, the space commercial launching insurance has taken shape. At pres- ent, the US, Russia, France and other major space powers already have the laws for space activities to standardize the commercial space launch insurance. But in China the commercial space launch insurance law system is in a situa- tion of disorderly regulations, and lack of basic legislation; it is also short of market rules for commercial space Launch insurance and solutions for such problems as specific disputes. In response to this, our country should supple- ment related provisions for space launch insurance to the existing insurance law, allow foreign capital insurance com- panies to come into the commercial space launching area, make space activities rules as soon as possible to standard- ize space insurance business, and establish outer space activities commercial dispute solving mechanisms including insurance dispute solving mechanism.
