摘要
随着我国海外投资活动的迅速发展,我国法人、其他组织及自然人的海外投资风险也在增加。我国现行海外投资立法存在严重缺陷,无法有效保障投资者的海外投资安全。文章介绍了我国海外投资风险的种类,分析了我国海外投资立法的现状及缺陷,并从立法角度提出了相应的完善措施。
With the fast development of China’s investment activities overseas,the risks suffered by Chinese legal persons,other organizations and natural persons from overseas investment are increasing.It’s impossible for our current legislation on overseas investment to effectively protect the safety of overseas investors,as there exist serious legislative flaws in this aspect.This article gives an introduction to the risk types of China’s overseas investment,makes an analysis of the legislative actualities of the overseas investment,points out the flaws,and comes up with corresponding improvement measures from legislative perspective.
