摘要
基于资源安全、环境法律责任、生态经济和WTO贸易与环境规则等立法依据和背景,结合国外立法考察、国内立法试点及其清洁生产立法要素论证等,回顾了《清洁生产促进法》的立法过程。总结了该法10年来的主要执行情况,进而分析了清洁生产实施存在的主要问题。
Based on the legislative foundation and background of resource safety, environment legal responsibility, ecological economy and trade and environment regulations of WTO, connecting with legislation investigation abroad, legislation pilot at home and argument of legislation factors for clean production, this paper reviewed the legislation process of Law on Promoting Clean Production. The main execution situation of this law in the ten years was summarized, and the main problems for execution of clean production were analyzed.
