摘要
性骚扰案件的低起诉率及原告的高败诉率反映出受害人权利救济的艰难,而证据问题是一个重要因素。性骚扰案件证据难题的根本原因在于性骚扰行为的隐秘性,因此,解决性骚扰案件的证据难题,既需要从事实层面与制度层面应对证据收集难题,也需要调整证明责任分配方式。
There are few victims who bring cases to courts, but most of them lose lawsuits in sexual harassment trials, which reflects the difficulty in the right remedy. Evidential problem is an important factor accounting for that. The fundamental reason for the evidential problem lies in the confidentiality of sexual harassment. The evidential problem should be resolved from the factual and institutional aspects, and the distribution of burden of proof should also be adjusted.
