摘要
城中村是我国在快速推进城市化过程中出现的一种新现象,城中村改造中的违法建筑,特指在城市规划区内的集体土地上,建造人违反国家法律、行政法规关于建筑行为的相关规定所建造的各种建筑物及其附属设施。对城中村违法建筑的处理应该遵循尊重历史、物尽其用、维护法律权威、比例原则等几项基本原则,对违法建筑的处理方式,应采取确认产权、依法没收、临时使用和依法拆除等具体处理方式。
The village in the city is a new phenomenon in the process of rapid urbanization.The illegal buildings in city village transformation refer to the unlawful constructions and auxiliary facilities which are built against laws and regulations in the planned urban and collective land.Handling the illegal structures should respect history,make the best possible use of everything and uphold the majesty of the law etc.The treatment of illegal building should adopt the following methods： affirmation of property right,confiscation according to the law,temporary use and removal according to the law.
