摘要
排污费计算依据是否正确、合理和可行,直接关系到排污收费法律制度发挥作用的程度。我国现行法的主要排污费征收项目为污水、废气、固体废物及危险废物和噪声,在计算依据上存在的问题主要是相关法律规定混乱、超标收费、浓度收费和三因子收费。
The correctness, rationality and feasibility of calculation basis of sewage charges are closely related to how pollution levy system works. Our current law mainly have sewage, waste gas, solid waste, hazardous waste and noise charges, existing problems are relevant laws and regulations confusion, over standard discharge fees, concentration fees and three factors fees. Corresponding legal improving measures are put forward in response to these issues.
