摘要
对于处于转型时期的我国而言,大量存在的罢工现象促使我们思考罢工权的宪法规制问题。基于宪政文明层面、现实层面和国际人权法层面对罢工权入宪的可行性分析,我国应当立足于中国特有的行宪机制,罢工权宪法规制的首要方式是采取修改宪法的方式。同时,中国宪法中的基本权利条款欲发挥效力必须通过立法具体化的途径,因此在入宪的基础上还要将罢工权条款写入相关法律之中,通过宪法确认和立法规范的制度构建解决罢工权的制度供给不足问题。
To China that is undergoing social transformations,the massive strikes press us for thinking about the right to strike in the constitutional stipulations.With a feasible analysis of the inclusion of the right to strike into the constitiution at the constitutional level,the reality and international human rights,this paper holds that,on the basis of current situations in China,the formulation of the right to strike must follow the amendment of the constitution.Meanwhile,to fully effect the basic rights as stipulated in the constitution can only be realized through legal materialization.Therefore,besides being included in the constitution,the right to strike must also be included in related laws,in order to provide suffcient legal support to the right to strike.
