摘要
近代中国的法律变革更多的是对西方法律的直接移植和简单模仿,而对自身固有法律传统却存在误解与漠视。实践证明,这样的法律变革并没有产生良好的社会实效。文章通过对近代中国法律进程、固有法律传统价值以及中国法学历史使命的反思,认为当代中国法制建设应当考察国情、立足现实,有甄别地学习西方先进经验,努力从固有法律传统中寻求力量,探索出一条汇通中西、既符合现代化潮流又彰显本土特色的法治之路。
The modern Chinese legal reform mainly transplants and imitates from western law, meanwhile there are full of misunderstandings and indifference for the Chinese legal tradition. Practice proves that the mod- ern Chinese legal reform doesn＇t bring good social effects. Through reflection on the modern Chinese legal process, the values on Chinese legal tradition, and the historical mission of Chinese jurisprudence, this paper holds that in the process of Chinese legal construction, we shall investigate our national conditions, base on the reality, learn selectively from the advanced western legal experience, seek strength from the existing legal tradi- tion, and explore a particular legal path that both accords with western modernization trend and embodies Chi- nese characteristics.
