摘要
我国农村土地产权制度在新时期日益显示其缺陷,主要表现在农村集体土地所有权的权属不明确、权能不全,农户土地承包经营权不完整。这种制度上的缺陷导致了农业经营的细碎化、土地流转困难和在征地过程中地方政府对农民权益的侵犯,从而影响了农村经济的发展和和谐社会的建立。对其进行改革,已势在必行。当前农村集体土地产权改革可以从改革的方向、基本出发点、重点、制度基础和初步实施等方面勾勒出其大致路径。
Our rural land property right system is increasingly revealing some defects such as ambiguities of al- location of landownership, incompletion of powers and functions of land property right, and incompletion of opera- tion right of contracted land. These defects have led to the broken bits in agricultural management, difficulties of land transfer, and local government＇ s violation of farmers rights ＆ interests in the course of land acquisition. Therefore, rural economic growth and establishment of harmonious society have been affected. It is imperative to re- form the system. The routes of reform can be sketched from the aspects of directions of reform, basic starting point, key points, system base, and preliminary implementation.
