摘要
小产权房是特定时期的特定产物,在客观上形成了两个截然不同的房地产市场,其负面作用要大于其正面影响。解决小产权房问题要分两步走:第一步,在现有制度框架内,通过调整优化现行政策来使存量小产权房合法化;第二步,政府必须进行正式的制度创新,改革我国农村集体土地制度,内化现有制度下小产权房的负外部性,在新的制度安排上彻底消除滋生小产权房的土壤。
The limited property rights housing is the product of a particular period and makes two distinct real estate markets,its negative effects is greater than the positive influence.Solving the problem of limited property rights housing should take two steps: firstly,within the existing system framework,by adjusting the existing policies to make the limited property rights housing legalization;secondly,the government must conduct a formal institutional innovation,reform our rural collective land system,internalize the negative externalities of the limited property rights housing of the existing system,comb-out the soil breeding limited property rights housing in the new institutional arrangement.
