摘要
劳动权不再局限于物理意义的生存价值,自我实现价值上升为本位价值。自我实现是多元社会中个人和国家行为联动力的结果,包括"自我决定"和"自我开展"两个要素。劳动权是自我实现和宪法秩序的整合规范,是一种社会国基本权利,其本质归结于人的自我实现。从宪法规范演进看,自我实现始终作为劳动权的显性价值而存在。劳动权保障和人的自我实现,需借助于劳动权功能构建,以劳动权的客观价值秩序促进自我决定,以劳动权的主观权利属性保障自我开展。
Labor rights are no longer limited to survival value in the physics significance, self- realization value rising to fundamental value. Self - realization is file results caused by system power of individual and the national behavior in the pluralistie society, including two factors: "self realization" and "self-development". Labor Rights is the integration of self- realization and the constitution order; is a kind of basic right of social country, whose essence attributes to self - realization. Protection of labor rights and human self - realization must be aided by construction of function of formulization of labor rights, promotes self - determination by the objective value order of labor rights, and protects the self - development by the subjective right attribute of labor rights.
