摘要
特留份制度是各国限制遗嘱自由的主要措施,我国《继承法》对此缺乏规定。本文在分析我国现行继承法第19条规定的基础上,指出其存在的缺陷。同时介绍特留份制度及其我国设立这种制度的必要性。
The particular section is the main measure used by all countries to restrict the will freedom.While the Chinese inheritance law lacks this kind of provision.Based on the defective analysis of 19th term in inheritance law,the paper holds that the particular section should be stipulated in the future law.And it gives the discussion of its emergency and development,and the analysis of its necessity.
