摘要
从法律思维上说,在现代知识产权制度的建构过程中,罗马法拟制思维发挥了非常重要的作用。现代知识产权制度通过对传统法的财产概念、私权以及国际贸易制度的诗性的(非逻辑的)"借用",为自己披上了舒适而坚韧的概念和制度的铠甲,从而获得了成熟而有力的法律保障。
From the point of legal thinking,the fiction thinking of Roman law plays a very important role in the construction of modern intellectual property system.By poetic（non-logical） borrowing of the concept of property and the system of private right and international trade from the traditional law,modern intellectual property puts on the comfortable and ironbound loricae of concept and system for itself,and gets the legal protection,which is an adept and powerful safeguard.
