摘要
"三权分立"是美国宪法中重要的组成部分,立法权、司法权和行政权相互分权立与制衡。但是三权之间并无明确的界限,总统和联邦最高法院也享有一定程度的立法权。这种立法权的分配模式为政党之间进行利益博弈提供了广阔的平台。研究了政党在美国宪政模式下的立法博弈途径及其对美国立法的影响。希望能够对我国立法民主化建设有所启示。
The system of separation of powers is an important part of the Constitution of the United States.The federal government was divided into three branches including legislative,executive and judicial body.With checks and balances,each of the three branches can limit the powers of the others.However,there is no clear boundary in three branches,and the Federal President and the Supreme Court also share the legislative power to some extent,This model of power-sharing provides the agency of the government with the platform of legislative game.This paper focuses on the methods of the legislative game between the two parties of the United States and the influence which brings to American legislation.Hopefully,it would be benefit to the research on the law-making process in China.
