摘要
近年来,为国外影视剧及动漫制作中文字幕的影视字幕组影响力日益扩大,而其行为却涉及与原作品的著作权纠纷。字幕组的行为是否合法,其免责声明是否可以免除其法律责任,以及字幕组为外国影视作品制作字幕的行为是否与原著作权人权利相冲突?分析其所涉及的著作权问题,并借助合理使用制度,可以试图调和字幕组与著作权人之间的矛盾。
In recent years, the influence of subtitle group, which produced Chinese subtitles for foreign TV drama and animation, is expanding increasingly. However, their behavior has caused disputes about copyright of original works. Whether the behavior of subtitle group is legal or not and whether the disclaimer is exempt from legal responsibility or not and whether the behavior of subtitle group, which produced Chinese subtitles for foreign TV drama, tort the right of the original copyright owner or not？ By analyzing the legal matter, which it involved, and attempting with the aid of the proper use system, this article tends to harmonize the contradiction between subtitle group and copyright owner.
