摘要
中日旅游法规体系,由于开始建立的时间不同,所以完整度也不同,且各具特点。主要体现在日本的旅游法规体系中有旅游基本法做龙头,而中国没有;中国有地方性旅游法规做补充,而日本没有。从旅游法规体系的完整度角度出发,我们还是应该学习日本的做法,出台旅游基本法统领整个法规体系。至于地方性的旅游法规则应该取消,其具有普遍意义的条文应吸收、合并到国家层次的旅游法规条文中。
Owing to the different time of establishment, China＇ s and Japan＇ s tourism legislations systems are quite different both in integrity and features, which mainly reflected in that Japan＇ s tourism legislation system is based on the initial tourism law, but it does not apply to China＇ s tourism legislation system. Regional tourism regulation emerged as supplemental legislation in China; however, it does not exist in Japan. From the perspective of integrality of tourism legislation system, it is a good practice to learn from Japan regarding its basic tourism legislation to be the core system. Regional tourism regulation should be abolished, simultaneously, some of the terms and conditions should be incorporated in the national tourism legislation.
