摘要
权利金无论在智力财产领域,还是在自然资源的用益领域,都是产权关系的体现;基于物的母体权利形成的权利束,是用益人以权利金为经济对价获取的物权性权利。运用物权的观念,对矿产所有权的权利结构从产权关系角度重新进行构造,以矿产权利金为连结资源所有权与用益权的经济纽带,培育以市场体现国有矿产资源所有者权益为主的资本机制,使国有矿资产在社会生产中真正转化成为国有资本,并获得应有的增值收益。
Royalty is a manifestation of property relations both in the field of intellectual property and the natural resources,and the bundle of rights from the property right as the parent right is the real right obtained from economic consideration with royalty by the usufructuary.Using the concept of property rights,we can reconstruct the mineral ownership structure from the perspective of property relations,and cultivate the capital mechanism which reflects the owners＇ equity of state-owned mineral resources through the market connecting resources property with usufruct by the mineral royalty which is treated as the economic ties,for the objective that state-owned mineral assets could be really transformed into state-owned capital and that value-added benefits due could be gained in the social production.
