摘要
保障残疾儿童受义务教育的权利不仅是政府的义务,而且是家长的义务。这种家长义务既是道义上的,也是法律上的。我国现有立法对家长义务的认识不到位、对家长义务内容规定不全面、对家长义务未履行时的制裁不合理等制度缺陷是导致残疾儿童受义务教育的入学率低、教育质量不理想的原因之一。从残疾儿童受教育权法制保障的角度讲,更新立法理念,强化家长的义务主体地位,将家长义务全面系统地纳入特殊教育法规体系,并增强其明确性和强制性,是发挥政府主导作用,保障残疾儿童受教育权的重要举措。
The protection of disabled children＇s right to receive compulsory education is not only the government＇s obligation,but also disabled children＇s parents＇ moral and legal duty.Such flaws as the incomplete awareness of and stipulations on parental duty in current legislations,and the unreasonable sanctions for failure to fulfill parental duty are the institutional causes for the low enrollment of disabled children,and the unsatisfactory quality of education.As far as the legal protection of disabled children＇s right to receive compulsory education is concerned,renewing the legislative concept,integrating parental duty into the legal system of special education in a comprehensive and systematical way,and enhancing its clarity and operability,are the important measures for the government to play a leading role in the protection of disabled children＇s right to receive education.
