摘要
公众参与是环境治理过程中的一项重要原则。环境治理中的公众参与是指在公共当局(主要是政府及其管理机构)和有关企事业单位所进行的与环境相关的活动中,利益相关的个人、团体和组织(比如环境NGOs)获得相关信息,参与有关决策,并督促有关部门有效实施相应的环境政策,以保障自身的权利并促进环境改善的所有涉及环境问题的活动。自20世纪六七十年代西方环境运动兴起以来,公众参与随着环境运动的演变发生了诸多变迁。公众参与环境治理既是一项基本的人权,也是促进民主政治发展、更加有效达到环境治理目的的一条重要途径。从审议民主视角来看,公众参与也是实现公民环境权的一种主要体现方式。国家必须创设有效的制度和参与渠道来保障环境治理中的有效公众参与,以最终实现环境问题的有效解决。
As one of the most important principles in modern environmental governance,the public participation means that individual citizen,groups or organizations such as Environmental Non-governmental Organizations（NGOs） access to environmental information,participate in decision-making and monitor effective implementation of environmental policies so as to protect their own rights and promote environment in public authorities or some corporations＇ specific activities related to environmental matters.The public participation has experienced great changes since western environmental movements emerged in 1960s-70s.The public participation in environmental governance is both basic human rights and an important approach to promoting development of democracy and improving environmental quality.It is also an important environmental citizenship of the public from perspective of deliberative democracy.Both national and local governments must ensure effective public participations in environmental governance through establishing good institutions so that the environmental problems can be resolved effectively.
