摘要
工程合同模式的选择不仅关系到工程项目风险的分担方式,也关系到对承包商持续努力工作的激励程度以及合同执行成本的大小。以按支付方式分类的工程合同模式为研究对象,提出了在综合考虑风险分担、激励及合同执行成本因素基础上,根据工程项目的风险水平及业主的风险管理能力选择合同模式的策略,并给出了相应的治理措施和建议,旨在为业主选择合同模式时权衡多种因素提供帮助。
The pattern of engineering contract is not only related to the risk sharing manner of engineering project, but also affects the incentive to contractor for continues work hard as well as the costs of contract execution. Taking the contract patterns classified by payment methods as research objects, the policy of selecting contract pattern according to the risk level of engineering project and the risk management capacity of the owner are presented after comprehensively considering the risk sharing, incentive and contract execution costs. The appropriate contract management measures and proposals for the policy are also presented herein to help the owner balancing in variety of factors when seleeting contract patterns.
