摘要
变性人的性骚扰案件遭遇现实尴尬,目前我国反性骚扰立法中保护主体仅仅为女性,存在着漏洞。应以"性别表情"作为变性人性别确认标准,以性骚扰具有"性本质""不受欢迎性""严重性"为性骚扰行为的判断标准,以期更全面保障变性人权益。
Transgender people are facing the embarrassment in sexual harassment cases.The current legislation of protection against sexual harassment is subjected only to women.There are many loopholes.We should take the ＂gender expression＂ as the standard of defining transgender people＇s sex identity,and use ＂sexual essence＂,＂undesirable＂ and ＂severity＂ as the criterion of sexual harassment in order to give more fully protect to the transgender people.
