构建国际工程承包合同管理的有效沟通框架

Establishing an effective communications framework for managing international project contracts

摘要 沟通管理是国际工程项目合同管理中最容易被忽视且不容易把握的内容。国际工程承包合同管理中的有效沟通主要是为了预防和减少合同争端,提高合同各方共赢的机会。因此,应不断拓展和创新有效沟通的渠道,构建有效沟通的框架,包括口头讨论并达成一致,书面确认并形成纪要;营造良好的面对面的沟通环境;开发固定程式的系统作为沟通的标准;建立台账系统以确保已完成的沟通可以追踪;定期召开总结会议,实现"早期预警"。在国际工程承包合同管理过程中,要针对业主的特点选用有效的沟通方式,以合同与事实为依据,强调利益共享、风险合理分担,激励合同双方提前发现问题、解决问题,以双方都受益为最终目标。 Communications management is often easily neglected and hard to grasp in the process of managing international project contracts.The purpose of effective communications is to prevent and reduce contract disputes and increase the prospect of win-win.To eliminate the margin of error in contract management an effective communications channel should be developed and constantly improved,and structured as follows:discuss and agree orally,confirm and summarize in writing;create the right environment for oral communications;develop a pro-forma framework for standard communications;have a logging system to track communications;have regular'wrap up' meetings to assure'early warning'.The required effectiveness of communication is based on the project owner’s needs,and transcends mere establishment of a mutually beneficial business partnership in the process of managing an international engineering contract. Effective communications in contract management means no diminished autonomy for the contractor or the owner,but rather benefit sharing and risk sharing. With the ultimate purpose of benefiting both parties,it encourages contract partners to anticipate problems and solve them in advance.
