摘要
随着集体林权改革的深入,林地流转在各地进一步展开,林地流转过程中也出现了一系列制度失衡现象,如不规范的私下流转、基层政府过度干预、采伐限额制约林地流转、林地转让价格偏低以及抵押困境等。究其根源有三:一是林地产权制度的残缺;二是林地流转制度本身的不完善;三是当前农民的社会生存环境不利于林地流转制度效益的发挥。建议对林地流转方进行生态补贴,加强对基层政府的权力制约,完善林地流转制度,改善农民的社会生存环境以促进林地流转。
With the implementing of collective forest tenure reforms,forest land transition prevails in many regions.At the same time,some institutional imbalance phenomena has emerged,such as transition in private,excessive government,harvesting quota,undervalued forest land transition,difficulty in mortgage of forest land etc.The causes of institutional imbalance in forest land transition were explored from three parts： limited forest land tenure,the imperfect forest land transition institution,unfavorable social living environment of rural areas.Some countermeasures were put forward,such as strengthening constraint of local government power,improving forest land transition system and social living environment of peasants to promote forest land transition.
