摘要
技术标准与专利结合，使得专利技术标准化趋势出现。这既有专利权主体受利益驱动的主观原因，也是客观因素使然。专利技术标准化对技术创新有积极影响，但亦可能造成技术创新惰性和阻碍技术创新。为克服专利技术标准化对我国企业技术创新的不利影响，应完善与技术标准相关的法律制度，尤其是专利信息披露制度；建立协调、整合机制，促进技术标准与技术创新的良性互动；发挥政府作用，促进事实标准形成；推动开放标准的制定和实施等。
The standardization trends of patented technology appear because of the combination of the standards and the technical patents. This is caused by the subjective interest-driven factors of the patentees and some other objective reasons. To overcome the patented technology standardizations adverse effects on enterprise technology innovation, we should improve the legal system related to technical standards, particularly patent information disclosure system; establish a coordination and integration mechanism to promote positive interaction between technical standards and technological innovation; accelerate the formation of the de facto standards through playing the role of government ; push the formulation and implementation of open standards.
