葡萄牙对吸毒人员非罪化的政策实践及启示 被引量：5

摘要 毒品非罪化理论认为将吸毒行为作为犯罪处理是不合适的,成本高昂的禁毒法律不仅不能解决毒品问题,反而是毒品问题的成因之一。葡萄牙的非罪化政策注重用治疗取代对吸毒人员的惩罚,不仅没有出现非罪化理论的反对者担心的毒品泛滥的情况,其毒品问题现状和其他国家比较反而更加乐观。我国的《禁毒法》在指导思想与基本立场和葡萄牙是一致的,但在实践中还要继续强调"救治"而不是"惩罚"的观念。
