摘要
关于"为他人谋取利益"的构成要件地位存在着各种学说,但每一种均存在着自身难以克服的困难。仔细分析,不难发现"为他人谋取利益"并不是侵害受贿罪法益行为的必然组成部分,它只是立法者用以限制受贿罪处罚范围而设定的"客观的超过要素"。在内容上,"为他人谋取利益"仅指行为人实施的受贿行为在客观上具有足以导致他人获利结果的内容,而并不包含"为他人谋取利益"的意图,也不包含在这种意图支配下所实施的行为。
Every one opinion about the status of congstututive of ＂seeking benefits for others＂exist their difficult which to be overcome by their present. It＇s no difficult to find that ＂seeking benefits for others＂ is really not to encroach on crime of accepting bribe following benefit behavior necessi- ty ingredient, but is the ＂status of constitutive requirements ＂set up to restrict crime of accepting bribe by legislator. ＂seeking benefits for others＂referes to that the act of accepting bribes will be enough to lead to others earn profit on the objective on content,and does not contain the intention seeking benefits for others,and does not include the behavior of accepting bribe which dominnated by the intention.
