摘要
在刑法分则规定了双重危害结果的故意犯罪构成当中,侵害或威胁随意客体的危害结果可能成为客观的超过要素,该要素具有区别于犯罪故意的主观心理,可以存在于独立或派生的犯罪构成内,在分则条文里有多种表现形式。
Harmful Consequences that are explicitly defined as a component part in the constitution of an intentional crime in the articles of specific provision of criminal law can be evaluated objective extra - element when they threaten or trespass on criminal optional object and show other psychology of criminal intent or criminal negligence. The very type of Extra - element can exist on independent constitution or derived constitution of a crime simultaneously, and perform different form of expression in the articles that prepare dual harmful consequences.
