摘要
随着社会经济的发展,我国台湾地区专利无效制度呈现出不同形态的变化。台湾地区现行的专利无效制度体系涵括了专利无效程序的启动、无效的法定事由、专利无效的审理、专利无效的法律效力等内容。台湾地区的专利无效制度有其缺点,也有诸多优点,它的优缺点为我国大陆专利无效制度的完善提供了若干有益启示。
With the development of social economy,the patent invalidation system in Taiwan Region has presented different forms.The current system is composed of initiation of patent invalidation proceeding,legal causes of invalidation,court proceedings and legal validity of patent invalidation,etc.There are some defects in its system as well as some advantages.Both of them are of useful enlightenment to improve the patent invalidation system in China's Mainland.
