摘要
有权威统计数据显示在江苏省"其他妨碍安全驾驶行为"是造成交通事故的首要原因。由于"其他妨碍安全驾驶行为"在法理上属于不确定性法律概念和概括性规定,理论上其法律属性不够明确,范围难以准确界定。执法实践中,其具体操作时涉及的行政裁量、程序性规制方面的问题亟待立法机关和行政部门进一步加以解释和规范。
Authoritative statistics show that the ＂other hamper safe driving behavior＂ is the main reason caused to traffic accidents in Jiangsu province .As the＂other hamper safe driving behavior＂ belongs to the uncertainty legal concepts and general provisions of the law in theory .Because lack of clarity of their legal property,its scope was difficult to accurately define specific operations related to administrative discretion and strictly procedural regulation in law-enforcement practice.So that needed to be further standardized.
