摘要
城乡分割体制下,农民和市民的权利体系及其实现系统截然不同。失地农民的权利在市民转化的过程中,原来较为完整的以土地为基础的农民权利被破碎化、被分别嵌入城市居民的分散的权利实现系统中。这个转换不仅因为嵌入而破碎,而且因为各方利益主体通过选择性适用法律对期待利益的激烈争夺而破碎。要使失地农民具备足够的城市权利实现能力,就要建立统一的法律规范、赋予失地农民以法定的土地期待利益分享权。
Under the organization of urban-rural split,the right and realization systems between farmers and citizens are differ-ent.In the process of converting,the past complete farmers＇ rights that based on land is crashed,and embedded into different right realization systems separately.Such transformation is divided into pieces due to embedment;more importantly,since differ-ent entities with different interests fight for the expected profit through selectively applying laws,farmers＇ interests and rights are encroached on so as to increase transformation cost.Therefore,if want ensure that farmers can hold enough rights of citizen and the ability to realize them,we need to establish consistent legal standards and endow farmers with legitimate rights to share land expected profit.
