摘要
电子签名、电子合同和电子认证的法律问题已经成为我国发展电子商务的"瓶颈"问题,其中,电子认证法律制度可以解决网上交易的信用安全问题,其法律关系的构建具有重要意义,包括多种类型,主要涉及电子认证服务提供者(主要是电子认证机构)、电子认证申请者(主要是电子签名人)、电子认证验证者(即电子签名依赖方)以及电子认证注册管理机构(简称RA)相互之间的民事权利与义务关系;所涉民事法律责任包括违约责任与侵权责任及其限制,采取过错推定归责原则。同时,对目前一些现实问题,尚需思考和完善,比如,电子认证标准不统一、电子认证服务业规则不规范、行业垄断和地方保护普遍存在等。
With the establishment of electronic certification increasing in China,the disputes about the electronic authentication are also emerging.The legal relations in electronic certification include several forms,in which there are two kinds of civil liabilities-the responsibility of breach and the liability for infringement which are also based on the principle of liability with presumption of negligence.We should put forward a proposal for the legislation and future development of electronic authentication in China.
