摘要
在网络著作权侵权案件中,证据的收集保全是诉讼的关键。网络证据的特点为网络证据保全公证创造了条件。虽然在刑事诉讼领域也存在网络证据,但是本文主要侧重于网络知识产权侵权所涉到的网络证据,结合相关案例,探讨了网络民事证据的保全公证存在的问题与对策。在搜集研究了有关的公证法律法规、规则、意见的情况下,通过分析近两年典型的网络侵权案例,采用法条分析、实证分析、比较分析的方法,揭示了存在的问题,并结合现有的技术水平和公证状况提出了完善网络证据保全公证的建议:一是完善网络证据公证保全的程序;二是提高公证人员的技术水平;三是建立统一的网络公证平台;四是加强独立的司法判断。
In the network copyright tort law cases,collecting and preserving network evidence is the key to the action,and characteristics of the network evidence contribute to evidence preservation by notarization.Although there are criminal network evidences,this paper mainly focuses on network evidence involved in the infringement of intellectual property.Combining with related cases,the paper analyzes the issues and countermeasures about preservation of network evidence by notarization.After collecting the notary laws and regulations and guidance,the paper,which adopts the methods of articles analysis,empirical analysis,comparative analysis,reveals the existent problems by analyzing the typical network infringement cases during the past two years.With the current level of notarial technology,the paper puts forward suggestions on preservation of network evidence by notarization： firstly,improving procedures of preservation of network evidence by notarization;secondly,improving the technological level of notary;thirdly,establishing a unified network notarial platform;fourthly,strengthening the independent judicial judgment.
