摘要
《物权法》对宅基地上私权流动问题未予回答,为目前法律解释和适用制造了混乱。在立法论上,应当从反思房地强制捆绑交易模式入手,重新界定房地关系,在谨慎对待宅基地使用权直接处分行为的同时,应毫无保留地支持农民对自有住宅的处分自由。按照平等、效率、自由和社会保障的要求,调谐房地异主以后权利人之间的关系,以地上权为枢纽构建允许私权处分的宅基地上权利群体系。
The Real Rights Law has no regulations on the private transfer of the rural residential land, resuhing in chaos in interpretation and application of law. From legislative perspective, the transaction model of compulsorily combining house and land should be reviewed to reconstruct the relation of land and house thereon. The direct disposal of the right to the use of the rural residential land should be treated cautiously, whi lethe free transfer of farmer' s own house should be strongly supported. Accordingly, adhering to the principles of equality, efficiency, free choice and social safeguard, the relations between rights holders upon separation of land and house should be regulated, and the various rights pertaining to the rural residential land which can be privately disposed should be established at the hub of the right to the surface of land.
