摘要
家庭承包经营责任制是中国特色的农地经营制度,随着生产力的不断发展和其他各方面不利因素对土地利用的制约,分散的、狭小的农户经营和大市场发生了矛盾,土地流转是解决这一矛盾的最好方式,但土地流转实际操作中还存在诸多问题。调查了怀化市鹤城区2004年至今的土地流转情况,对现行农地产权制度存在明显的缺陷、土地流转的管理机制、服务机制不健全及土地流转合同不规范等问题进行了探讨,并提出了农村土地流转的创新机制。
The household contractual management responsibility system is a kind of farmland management system with Chinese characters.With the development of productivity and the restrictions of other unfavorable factors on land utilization,there are some conflicts between separate management of farmers and big market.The land circulation is the best solution for these conflicts,but there are many problems in practical operation.The status quo of land circulation in Hecheng District of Huaihua City since 2004 was investigated.Then,based on the investigated results,the problems,such as obvious defects in present farmland property right system,imperfect management mechanism and service mechanism of land circulation,and non-standard contract of land circulation etc.,were discussed.In the end,the mechanism innovation of rural land circulation was proposed according to the problems.
