摘要
分析了因违法招投标导致建设工程施工合同无效的两种情形,阐述了黑白合同的法律后果以及认定黑白合同的构成要件,指出因违法招投标致施工合同无效与黑白合同在法律依据、操作过程、法律后果方面存在的区别。
The paper analyzes the two circumstances of invalid contract in construction project led by the illegal bidding,elaborates the legal consequences and elements of black and white contract,points out the differences between invalid contract led by the illegal bidding and black and white contract in legal basis,operation and legal consequence.
