摘要
集体建设用地流转的实质是实现土地的商品属性,关键是多方主体的利益分配。文章基于博弈理论,对地方政府和农村集体经济组织、农村集体经济组织和农户进行博弈分析,建立相应的博弈模型,并通过安徽芜湖和山东淄博两地集体建设用地流转的实际情况进行实证分析,得出的结论是集体建设用地流转应在政府的辅助下由土地的主体农民自主流转,同时政府也应发挥其监督引导职能,使集体建设用地规范流转。
The essence of collective construction land transfer is to achive the product attribute of land, and the key is benefits distribution of multi-subject. Based on game theory, the paper analyses the relationship between local government and rural collective economic organizations, as well as the rural collective economic organizations and farmers. Then a corresponding game model is established, and the actual situation of collective construction land transfer is analyzed in Wuhu city and Zibo city. The conclusion ts that the farmer is the main body of collective construction transfer while the government is the auxiliaries. At the same time, the government should supervise and guide to norm the collective construction land transfer.
