摘要
我国土地督察制度建立于2006年,至今与土地督察有关的法律法规及政策性文件均未涉及听证程序。这种现象导致土地督察部门缺乏有效外部监督,土地督察决定执行重重受阻。同时,地方人民政府及行政相对人的权益难以得到保障。因此,在土地督察制度中引入听证程序显得十分必要。
Land Supervision System of China was established in 2006, however, there have neither law nor policy related to hearing proce- dure now. This phenomenon has led to lack of effective external oversight and the decisions of land supervision encounter heavily obstructed when implemented. Meanwhile, the rights of local people＇s government and administrative relative person can not be protected well. Therefore, it is necessary to introduce hearing procedure to the Land Supervision System.
