摘要
近年来,美国利用知识产权保护措施制造贸易壁垒十分盛行,中国企业在美国国际贸易委员会(ITC)被提起337条款调查的案件急剧上升,败多胜少,损失惨重。但江苏圣奥化学科技有限公司不畏艰难,勇于迎接挑战,利用法律武器赢得了跨国官司,扩大了国际市场,为国内出口企业制定知识产权战略提供了经验。针对美国的337调查,中国企业不仅要积极应诉,而且应该未雨绸缪,提升企业自身的核心竞争力,主动在美国申请专利,或对美国竞争者的相关专利提起无效诉讼,巧妙利用美国法律体系维护自身的合法权利。
It is very common recently that the United States use intellectual property rights protection measures to add barriers to trade,and the cases that Chinese enterprises involved in the investigation on Section 337 of US Tariff Law sued by ITC are dramatically increasing.However,Chinese enterprises have lost the cases most time and suffered great loses.Jiangsu Sinorchem Technology co.,Ltd.has not given up to difficulty but courageously accepted the challenge and won the transnational lawsuit case by taking advantage of legal weapons,so as to expand the international market share and provide experience for domestic export enterprises to develop strategies for intellectual property.For the purpose of the US 337 investigation,Chinese enterprises should not only actively answer lawsuits but also take precautions.They also need to improve core competitiveness of themselves and apply for a patent positively in the USA.Alternatively,they can propose an annulment suit to the relative patents of American competitors and safeguard their lawful rights by skillfully using the USA legal system.
