摘要
韩国的协议离婚立法规定了离婚的考虑期、法院的离婚确认制度、离婚的户籍申告制度及对离婚的无效和撤消制度,相对于中国法律规定的协议离婚立法,更加严格与完善。由于中国与韩国都属于东方文化的国家,因此韩国协议离婚立法的规定对我国立法更具有借鉴意义。
Procedures of divorce by agreement in ROK include period of consideration,court＇s confirmation,and declaration of divorced household register as well as verdict of divorce invalidation and revoking.Comparatively,such procedures are more strict and reasonable than those carried out in China when a case of divorce by agreement is handled.As both China and ROK belong to the circle of oriental cultures,it will be of great significance for China to perfect its laws when the relevant procedures in ROK are referred to.
