摘要
体育事业是公益事业的组成部分,体育领域中存在着国家利益、公共利益和不特定的多数人的利益。在我国从体育大国向体育强国迈进的过程中,社会和体育发展需要依法保护公共体育利益,面对侵害体育公共利益和公民体育权利的违法行为,现有的法律救济手段由于自身局限性,在制裁、纠正违法行为和保护公共利益方面还不能起到很好的作用。现行法律法规为公益诉讼制度引入体育领域中提供依据,同时现代社会进步和诉讼权理论的发展以及其他领域的成功经验,使体育领域实施公益诉讼成为可能。在体育领域实施公益诉讼,可以拓宽公益诉讼的受案范围,更好地维护国家的公共利益和公民的体育权利。
Sports business is an integral part of public welfare.In sports field,there are national interests,public interest and non-specific interests of the majority of people.In the process of transformation from a big sports country to a strong sports country,public sports interest needs to be protected by law with the social and physical development.In the face of an offense against the public interest and sports rights,the existing means of legal relief can not play a good role as a result of their own limitations,on the sanctions,the correction of violations and the protection of public interests.Existing laws and regulations provide a legal basis for public interest litigation in the introduction of sports.In the progress of modern society,development of the right of ac-tion theory and the successful experience of other areas,make it possible to carry out public interest litigation in sports field.Bringing public interest liti-gation system into sports can broaden the scope of the case,and safeguard the country’s public interest and civil rights of the sport.
