摘要
准确性是立法语言的灵魂与生命,是立法者孜孜以求的主要立法原则之一。但由于各种主客观因素的制约,立法过程中不可避免地要运用模糊语言。模糊语言的使用一方面保证了法律法规的适用性,另一方面也给司法实践带来了一些问题。本文分析了立法语言中模糊语言的存在理据,以及对法律制度的积极功能和消极影响。
Exactness is the soul of legislative language and one of the legislative principles pursued by the lawmakers.However,fuzziness is inevitable in legislative language.Fuzzy language helps to maintain the universal applicability of law;and meanwhile brings much trouble to the jurisdiction.This paper analyzes the causes of fuzziness,its value and its damages to the rule of law.
