摘要
著名民法学家杨立新教授是当代中国研究亲属法最卓有成效的学者之一,其亲属法研究生涯已逾30年,引领和见证了中国亲属法理论的现代化。杨立新教授倡导对身份关系的现代解读的指导思想为中国亲属法理论研究的腾飞提供了正确的指引,其亲属法学术思想主要包括亲属法理论体系、亲属法一般理论、婚姻法律关系、亲子法律关系、亲属法律关系、亲属财产法律关系、中国民法典亲属法编的起草思路与总体构想等方面。杨立新教授几乎对亲属法领域中的大多数问题都做了深入创新的研究,不少领域的研究和课题都处在领先地位,其中大部分的观点已经被国内学界奉为权威和经典,并在国内外学术界产生了重要的影响,为中国亲属法理论研究做出了杰出的贡献。
Prof. Yang Lixin,the famous jurist of civil law in modern China, is one of the most outstanding scholars whose academic research scope focus on relative law. His academic career has been over thirty years, as the role of leader and witness of modernization of China relative law theory. Prof. Yang Lixin provided the basic as well as correct directions for relative law research of China by proposing modern interpretation of relative relationships. His relative law academic thoughts include theoretical system, general principles, marriage relationship, parentage relationship, family relationship, relative property relationship, and draft blueprint of China Civil Code. Prof. Yang＇ s research scope is so broad that it almost covers all the domain of relative law, most of which are top and treated as authentic views in China. In short, Prof. Yang Lixin has made a notable contribution to relative law theory of China.
