摘要
矿产资源流转中国有资产频频流失已成为近年社会热点问题之一,本文以采矿权为视角,从采矿权出资、转让时国有资产保护的产权制度缺陷和法人治理困境两方面入手,提出应该明晰矿产资源产权内涵,确立国家的民事主体地位,建立以公共治理模式为主导的矿山企业法人治理机制。
Damage to state-owned property is a hot issue in the flow of mineral resources. From the perspective of mining lease, the essay analyzes pay of mining lease, the disadvantages of the protection system of state-owned property and dilemma of corporate. The essay suggests the clear definition of property of mineral resources, the establishment of State＇ s civil status and offers a system of common management.
