摘要
违法性的含义和功能不同于过错,有其独立的存在价值,故自罗马法以来就以不同方式存在于各国民法上。违法性要件的独立设定,可以克服一般条款解释适用上的困难,有利于自由保障和权利救济双重价值的综合平衡,有助于广泛保护各种民事权利和法益,可以为正当化事由及无过错责任提供理论依据。违法性的判断标准具有一定的弹性,判断方法宜采取"行为不法说"。我国侵权责任法规定了违法性要件。
Different from fault,the concept and function of illegality have independent values in civil laws of different countries in different ways dating from the Roman law. The illegality requirement should be set independently to overcome the predicament in interpretation and application of general terms,to achieve the comprehensive balance of freedom and rights remedy,to better protect various legal interests and civil rights,and to provide a theoretical basis for justifications and strict liability. Since the criteria of determining illegality have certain elasticity,the doctrine of illegal actions should be adopted. The illegality requirement has been regulated in the Law on Tort Liability in our country.
