摘要
象刑本身是一个颇具争议的问题,不同的学者对它在历史上是否存在及其作用有着不同的看法。本文在肯定象刑存在的基础上,从象刑的适用对象这一角度出发,阐述了它与"刑不上大夫,礼不下庶人"在起源上的关系,从而推出象刑为大夫违礼行为的一种制裁方式的观点。
＂Xiang Xing＂ penalty, as it were, is a historically controversial issue, and scholars differ in their views over whether it had existed and how well it had functioned in history. In this paper, the author confirms the existence of ＂Xiang Xing＂ penalty, and, from the aspect of the object of application, elaborates on the relationship between the application of ＂Xiang Xing＂ penalty and the legal doctrine of ＂Criminal Law Not Applying to Senior Officials and the Etiquette not Applying to Common People＂. Then the author concludes that ＂Xiang Xing＂ penalty is a way of punishing senior officials in feudal China for violation of proprieties.
