摘要
西部的和谐,关系到国家的可持续发展,在西部特殊的地缘政治环境下,群体性事件往往和民族问题、边境问题交错在一起,给群体性事件的解决提出了更高的要求。刑法是社会治理的最后一道防线,对群体性事件的理性处置,不仅仅是刑法功能如何发挥的问题,同时也拷问着地方党政领导的政治良知。从刑法之上、刑法之外研究刑法,解读刑法背后的政治伦理,从而指引刑法审慎介入群体性事件、理性甄别群体性事件、妥善解决群体性事件。
The social harmony pursued in western district regulates the development of the country gradually in China. Because of the special geo - political environment in the western district and the complexities factors concerning ethnic issues and border issues together, there are some higher requirements for group events which must been resolved. Generally, Criminal law is the last way of public order of administering in China. We should have an ethical analysis on criminal Law for group events, and explain the political ethics behind criminal law. We think that this is very helpful to resolve the problem properly.
