摘要
法律制度是劳动关系的调整器,它决定和影响着劳动关系运行的状况。当前,我国虽然已初具调整劳动关系的法律政策体系,但在制度设计和制度实践方面仍然存在诸多缺陷。这既不利于劳动关系的协调发展,也不利于劳动者合法权益的实现。因此,要走出劳动关系法律规制的困境,需要我们以科学性原则指导法律制度建设,在制度实践中实现劳动者的"增权"以及改革和创新地方政府绩效考核机制。
The legal system is the regulator of labor relations,and it determines and affects the operational state of labor relations.At present,China has the system of laws and policies about the adjustment of labor relations,but many deficiencies still exist in the system design and the system practice.That is bad for the coordinated development of labor relations and the realization of the legitimate rights and interests of laborers.Therefore,to get out of the predicament of legal regulation of labor relations,it is necessary for us to guide the legal system construction by scientific principles,realize the "empowerment"of the laborers in the system practice,and reform and innovate the assessment mechanism of the local government performance.
