摘要
通过分析工程总承包模式下各参与主体之间的委托代理关系,借用委托代理理论中信息不对称和契约不完备两个特征,针对委托代理关系中所存在的问题进行深入分析,从总承包商的选择和评估、引入专业分包竞争机制、完善法律法规、加强合同管理和转移风险等方面提出建议。
Based on the analysis about the principal-agent relationship among participants of general contract mode, the paper discusses the existing problems in principal-agent relationship by the two characteristics of information asymmetric and imperfect contract. Then it puts forward suggestions from selection and evaluation of general contractor, introduction on professional subcontract competitive mechanism, perfection of laws and regulations, strengthening contract management and transferring risks and so on.
