摘要
产品责任法律制度是我国产品质量法律制度的重要组成部分。由于我国产品责任法律制度建立较早,随着市场经济的发展和我国加入WTO后市场的进一步开放,现行的产品责任法律制度已不能适应形势发展的需要,需在借鉴市场经济发达国家产品责任法律制度的基础上,根据我国的国情对我国的产品责任法律制度进行重构。
The legal system of product responsibility is an important part of the system of product quality in our country. Since the legal system of our product responsibility was constructed earlier, moreover, with the development of market economics and the further open of market after China entering into the WTO, the current system cannot adapt to the development of the situation and circumstances. It is necessary to reconstruct our legal system of product responsibility according to the condition of our country, based on the legal system of those countries with evolutionary market economy.
